Question by doug: Can my doctor refuse to transfer me to another doctors care that is closer to my home?
A new substance abuse clinic just opened up in my town. It is 2 blocks from my house and the one am currently going to is 4 miles away. The doctor that runs the new clinic used to work for the other clinic and his clinic is at their previous location. Since they have moved it is not convenient for me because I don’t have a car. I was told that I would not be allowed to transfer because the doctor “stole patient information and contacted patients to come to his new clinic”. He used to work for the other clinic and when they moved he decided to open up his own clinic. If he used to treat us I don’t see how he could steal patient info since he was our doctor, but the truth is I contacted him. On the wall under patient rights and responsibilities it says “upon acceptance of another treatment program, patients have the right to a smooth transfer”. A lot of other people have been told they could not transfer either. We were told that they have to have a meeting to see how they are going to handle this and that there may be a law suit against this doctor for stealing patient information. Is any of this legal? I think we may have grounds for a class action law suit.
