Contractual Law Question?

We live in Maryland, and in March of this year, I had to take my daughter to the emergency room. I dutifully paid my emergency room co-payment charge, and the doctor’s fees. I was told the rest would be handled by my insurance company (Blue Cross).

A few weeks later, I received a bill from the hospital stating that laboratory fees ($66.20) and emergency department fees ($169.70) came to a total of $235.90. My insurance company paid them $238. An overpayment of $2.10. Now they want an additional $164.10 from me. Various calls to their customer service department resulted in various answers ranging from “Oh, I think there is a mistake” to the latest “Our contract with your insurance allows us to demand this even though the procedure did not cost that much.” Of course, I have never seen the contract, and my demand to be given a copy was ignored

My contracts law class was a long time ago, but I do remember that not all clauses in contracts are necessarily enforceable. Advice? Thanks!

Why is it that republican and religious and secular conservatives continue make family values an election issue. The issue of family values and morality was ONE of the hallmark reasons for the Republican take-over of congress and it was also used as a theme during Bush’s first run for office.

POPULAR SCANDALS

1.Senator Larry Craig, recently pleaded guilty to lued homosexual acts in an Airport. He still defiantly claims that he is not gay.

2.Mark Foley, had phone sex and indecent conversations with male pages.

3.George W. Bush, Republican president, accused in a criminal complaint and lawsuit of raping Margie Schoedinger, who later committed suicide. Accused by Tammy Phillips, a former stripper quoted in the National Enquirer in 2000 saying she had an affair with Bush that had ended in 1999

4.Senator David Vitter (R-La) who ran a hard-core platform on traditional family values, name was found on a Madams list. He told his constituents that it was a “private issue” and to leave him alone.

5.Arnold Schwarzenegger, Republican governor, had sex with a 16 year old when he was 28.

6.Joe Scarborough, former Republican Congressman, currently a conservative talk show host. Resigned his congressional seat abruptly to spend more time with his family, amidst allegations of an affair. His intern, Lori Klausutis, was soon after found dead in his office. The medical examiner, who had his license revoked in Missouri for falsifying information in an autopsy report, and suspended in Florida for six years, ruled the case an accident, after giving conflicting information about her injuries. He said he lied about them because “The last thing we wanted was 40 questions about a head injury.”

7.John E. Peterson, Congressman (R-Pa), accused of sexual harassment and creation of a hostile work environment by six women. Peterson has refused to admit a crime, saying only “I may have been an excessive hugger.”

8.Henry Hyde, Judge who oversaw Clinton’s impeachment proceedings, prominent opponent of reproductive rights, who had an extramarital affair with a woman who was married and had three children, during the course of which she and her husband were divorced.

9.Newt Gingrich, married three times. Gingrich campaign worker Anne Manning admitted that she gave Newt oral sex while he was still married to his first wife. Informed one wife he was filing for divorce while she was in the hospital recovering from cancer treatments

10.Richard A. Dasen Sr., Republican benefactor of conservative Christian groups, convicted of sexual abuse of children, promotion of prostitution and several counts of solicitation, enough to add up to a sentence of 126 years in prison

Conservative Personalities and Figure Scandals

1.Paul Crouch Televangelist, Former President of Trinity Broadcasting Network (TBN). Paid $425,000 in hush money in an attempt to cover up a gay affair.
2.Ted Haggard, popular conservative pastor who advised Bush on Family Values issues was outed by a male prostitute who also alleged that he gave Haggard drugs.
3.Rush Limbaugh, triple-divorcee
4.Bill O’Reilly Right-wing conservative talk show host on Fox News, sued for sexual harassment by his producer.
5.Dr. Laura Schlessinger, right wing conservative radio host. Promotes family values, estranged from her mother, opposes birth control, has had her tubes tied, espouses saving oneself for marriage, admits to having had sex before she was married, opposes adultery, has committed adultery while she was married, and has slept with a married man, opposes divorce, is divorced and remarried, has posed for nude photos which are available online.

There are many, many, many more. I know that I am going to be accused of being repub-coserv-basher. I am not, I know the democrats have just as many scandals if not more. However, I think that the whole PLATFORM OF CONSERVATIVE FAMILY VALUES IS A DISINGENIOUS strategy to rally votes and to swing elections. THIS LIST DEMONSTRATES THE FACT THAT NO ONE PRACTICES WHAT THEY PREACH!!!
I also believe that we are all human and everyone makes mistakes, but it is VERY HYPOCRITICAL to impose ideas that these “cultural-icons” don’t keep!

Do I owe money back for a overpayment check that was issued to me twice?

My wife went in to have a hospital test done. I asked them up front how much it would cost and even though it was a standard procedure they couldn’t tell me. They wanted me to just pay a little and I said I wanted to pay it all up front, so I wrote them a check for $400. A month later I got a check because I overpayed about $30. Then 2 months later I got another check for around the same amount. I had pretty much forgotten about the first check by then and didn’t think anything of it. Now about 4 months later they call me saying I OWE them $30. First off I don’t owe anything. I paid up front and it was their accounting mistake that was the problem, but they are trying to blame me saying they’ll put it on my wife’s credit report and tried to accuse us of calling them to have a duplicate check written. I don’t mind paying any bill that I owe but the fact that they are being accusing and I have to pick up the slack for their mistake and also I ultimately lose out if I don’t pay

Medical malpractice? Deal with Doctor or consult a lawyer?

My friend went in for 1/2 hour outpatient procedure. When she woke up it was over 24 hours later with major surgery. spent many days in icu and missed a lot of work. The doctor made a mistake somewhere along the line. She does not want to put the doctor through the ringer, she understands it was a mistake. She does want her medical bills taken care of and I told her to get a little more to help with a mortgage, couple hundred thousand, not millions. So the question is would it be better to deal with the (doctor, hospital) or talk to a lawyer who will want to get a settlement for millions so he can make a lot of money and drive up insurance costs?

Friend owes over 100,000 dollars in hospital bills?

I closed the answer poll by mistake,but my friend got shot in the leg outside in a drive by, they were shooting at someone else and he was innocent bystander getting out his car,but he lives with his mom and he has no insurance, so after the surgury they charged him over 130,000 dollars in bills…what can he do to fix his credit and get rid of these bill which is dam near impossible for someone to pay off
