She will say it was your Idea. If the insurance company wants to file charges then they can or they will take you to civil court to pay for any damages (Meaning anything they paid out for her care.) A good friend of mine had an ex-wife. Keep in mind she is an EX wife. She filed for welfare while receiving child support from him. Guess who had to pay for the welfare? Yep, my friend. All 30K of it. So don't think they won't come after you.

Fraud is fraud, You cannot say that you had no clue to what she was doing. I don't think it would be insurance fraud. I think insurance fraud is when you do something to intentionally get something from the insurance company. Like if you wrecked your car and claimed injuries you really didn't sustain. If she was really sick or getting regular checkups and using the insurance for that, I don't think that's fraud. Just my 2 cents!

I think that if there is proof that she committed “marriage fraud” that maybe the insurance company could go after her civilly for monies that they have put out for HER.
