How Can You Prove Insurance Fraud in a Car Accident?

I was in a car accident where a guy slammed on his brakes when I was making a lane change. This happened in 2006 and I was told that I was not at fault because he braked due to an accident within a certain distance in front of him. Now on this billing cycle in 2008 they raised my insurance. When I called they said it was due to that accident. They had settled. There was 1500 dollars in damages to his car, bumper and paint job and medical of 24000 dollars. The accident was less than 10 miles per hour. Neither one of our airbags deployed. My insurance company never even contacted me saying that they were shifting fault.

Can I prove that it is an insurance fraud after the insurance settled?

I don’t see anyway that 24000 dollars of medical bills is possible.

Do I have any investigation avenues?

    no you can not, just because you werent at fault doesnt mean that your insurance company didnt receive losses from man hours and monies paid for actions after the accident.

    you can claim what you want but the matter of fact was that you were in a car and you hit someone whether he stopped or not.

    You are SOL. If your insurance company settled this case, you do not have a leg to stand on.

    Fault here makes no difference. Your insurance company paid the claim. If there was fraud, do you think they would have paid? You can ask your insurance company to look into the matter, but I’m betting they won’t. You can also report your suspicions to your state insurance commissioner

    It isn’t your place to try to prove insurance fraud. The insurance company just doesn’t give people a blank check. Insurance companies aren’t stupid, they would have done their own investigation before making a settlement.

    You rear ended the other driver, you did not maintain proper lookout or distance between the vehicle infront of you while you were changing lanes.

    If your company decided that you were liable for the damages, what fraud is there? Its possible this person suffered from injuries

    And with the premium just increasing now, that is likely because the claim just recently settled. CA has a 2 year statute of limitations (time you have to file a claim) for bodily injury.

    If your insurance would have thought the other driver was making a fraudulent claim, they would have investigated and denied, but since they paid out, I’m sure they felt the claim was legit.

    Can you prove fraud? Sure, just go out, hire a private investigator who will charge you between $100-$1,000 a day plus expenses to investigate the guy (hopefully they can do it in two weeks). Assuming the P.I. can find anything you can then hire a lawyer to sue the other guy to recover for the false injuries. So in the end you would have spend a few tens of thousands of dollars to save $1,500.
