I was notdriving I was in the passenger seat. My stupid cousin was drivin too fast and she hit gravel then the car spun out. Then rolled over a bunch of times then finally hit a cement embankment. Now everyone kept on sayin that I couldn’t go and sew my uncle he’s family it wouldn’t be right. So durin all that i acquired over $500,000 in medical bills and instead of my uncle doing the right thing and just forking some money over he went out and bought a $50.000 car. Never once gave up anything nor offered anything. Not even an apology for his stupid daughters mistake. so when I get out the hospital everyone is still in my ear about not sewing so the insurance company sent me a settlement and me not even being anywhere in the right mind and getting all this input from everyone else accept an lawyer signed it. I have 10 pins and 2 steal rods in my back I cant walk. My life is changed forever. even though i signed the settlement is there anything I can do to get these bills taken care of

    No you should have never signed that settlement you should have gotten a lawyer and sued then you would have your medical bills paid off and also received money for your injuries.

    Sue him! Family is nothing if they don’t own up and accept the consequences of their actions.
    They have as much of a responsibility to you and you do to them. If they do not respect you as family, why should you.
    Regardless….I’m assuming they have insurance…..If so, they won’t pay a penny! It will be the insurance company.

    You need to talk to a better lawyer! You should have never setteled! My heart goes out for you, but you can’t stay mad at the driver, I’m sure it was truely an accident. Forgive the mistake and move forward, work on making the best of where you are right now. Definitly call a better lawyer, you should be able to get all your bills paid plus, youre gonna have to personally sue. Good luck.

    Well, you can go to the hospital billing department and ask them if there are programs to help people who have had catastrophic injuries to pay the bills. Such programs usually do exist, and they usually will ask for things like how much money you have, are you on state assistance, things like that.

    Or, you can file for bankruptcy. It could still be an option even after getting the assistance through the hospital.

    I am so sorry to hear about all you’ve been through. As for your ability to sue your uncle, that depends on several things. Was the settlement that you signed with just your uncle’s insurance company, or did you also release him from liability in the process. You must read the settlement, your rights will be stated there. If you settled with the insurance company only you may be able to bring a suit against your uncle, but it really all depends on the terms of the settlement. You will have to consider the amount of time that has passed since the accident – the usual statute of limitations for accident cases is 3 yrs from the date of the accident, but this varies from state to state. You can’t sue your uncle after the statute of limitations has run, so that’s an important factor. Your best bet would be to bring the settlement agreement, your medical bills, the police report filed at the scene of the accident, if any, and any other documents you may have to an attorney. Most offer free consultations so they can tell you about your chances of success without you spending a dime . I wish you the best of luck and hope that you are able to get your life back to normal.     I am so sorry for your misfortune. There are steps you can take. If the check or the lawyer didn’t say that upon receiving the check this stops you from any further suits against the company, or you didn’t agree to that, you may still be able to sue his insurance company. This may sound a little crazy, but in some states, if you have full coverage on YOUR vehicle, you can sue your own company for medical expenses. Unfortunately, that will make your premium go up. The only resolve other than that is a civil suit against your relative. Do you have any insurances with your job? Like short term and long term disability? These can help off set some of the expenses as well depending on how the plan works. Unfortunately suing a relative is a hard decision, but all the people who are giving you advise are not going through the pain and suffering you are experiencing, nor live your life after all this blows over. Some lawyers give free consultations, I would find one that does and find out your options. They would best know how to handle the laws in your state.

    Need some clarification to answer your questions properly:
    1) In what state did the accident occur? and when?
    2) You were NOT attorney represented?
    3) DId you receive the policy limits from your Uncle’s insurance company?
    4) Did your cousin have her own auto policy in effect on the date of the accident? If so, then her personal auto policy would be excess over the policy on the car she was driving.
    4) Do you have health ins coverage? If not, then under the circumstances you should be able to qualify for Medicaid.
