What Can I Do About the Doctor’s Mistake?

My wife was given a prescription to reduce the swelling in her feet. It was HCTZ. Her records report she has always been allergic to sulfa drugs. We have used this Doctor for years. HCTZ has sulfa in it, she had a major reaction to this that took her out of work for two weeks, so it could clear her system. She had to take an ambulance to the hospital. The doctor is aware now of what happened, but offered to only fix it. What do I do about the bills from the hospital and ambulance?
Actually, my wife trusted him, and when she visited him the next day after she was out of hospital, he had to check the computer for its ingredients. He didn’t really know. That is crazy. He isn’t a backwoods doctor. The ingredients list from the drug company doesn’t say sulfa, it uses a more direct terminology that most laymans do not understand.
I am not looking to gain from this event. I just don’t want to lose, either. I understand mistakes, and if I were to make one I would have offered to cover the expenses. I don’t need his insurance to sky rocket, or be greedy and want a lot of money. Just the bills are fine with me.

Sue him. I he knew she was allergic to it, he shouldn’t have given it to her. Just remember to bring all your proof.
Then again, she did take the medication and must have known what was in it so it’s her own fault if she disregarded the sulfa.

The doctor’s actions constitute gross negligence for which the doctor must be held strictly liable.
This is why doctors pay enormous medical malpractice insurance premiums. You are talking about sufficient damages to warrant an attorney. If you tell the doctor that you want him to repair his mistake and he refuses then hire an attorney.
Well, he shouldn’t have written the script, but your wife shouldn’t have taken it either. Just the same, get a lawyer and the doc’s malpractice will cover your med expenses etc. That’s why he pays so much in malpractice insurance, in case this happens. Everyone makes mistakes, even doctors and especially in health care you need to be your own advocate.
Sorry to hear about your wife, have you guys been using the same pharmacy for a while now? Seems like they should have also had her allergies on record… If so, I would talk to them too, most of the drug prescription stuff is computerized now and that medicine should have raised a red flag in their system.
Maybe you can get the doctor to pay for whatever costs your insurance does not cover.. Otherwise it will take a long time, and a lot of money to bring a medical malpractice claim.
I would say between the doctor and the pharmacy you should easily be able to cover the medical bills, no want wants to go to court over this stuff.. it literally costs a fortune in both time and money…
